The EU Settlement Scheme (EUSS) is how EU, EEA and Swiss citizens and their families secure their status in the UK after Brexit. This 2026 guide explains who qualifies, the difference between settled and pre-settled status, how to apply, and the new automatic settlement process.

Who is eligible?

The scheme is for EU, EEA and Swiss citizens (and certain family members) who were resident in the UK by 11pm on 31 December 2020 and can show the required period of continuous residence. Some joining family members can still apply.

Settled vs pre-settled status

  • Settled status — granted where you have at least 5 years of qualifying continuous residence. It’s a form of indefinite leave to remain.
  • Pre-settled status — granted where you have less than 5 years. The rules are now simpler: a pre-settled holder can be granted settled status with at least 30 months’ residence in the most recent 60-month period.

How to apply

Applying is a free, digital process through the Home Office EUSS portal. You’ll prove your identity, your qualifying UK residence and your eligibility under Appendix EU. Your status is held digitally as an eVisa, which you view and share online — for example to prove your right to work or rent with a share code.

Automatic settlement (from 9 April 2026)

The Home Office has expanded its automated conversion of pre-settled to settled status. It now uses a simpler residency test based on HMRC tax or DWP benefit records — at least 30 months in the most recent 60-month period. Where settled status can’t be granted automatically, pre-settled status is extended by a further 5 years, so no one loses their rights for failing to reapply in time.
