UK Visa Refused 2026: Administrative Review, Appeal or Reapply

UK visa refused - refusal letter with magnifier and options

A UK visa refusal isn’t always the end of the road — but your options depend entirely on what your refusal letter says. This 2026 guide explains administrative review, appeals, reapplying and judicial review, and how to choose the right one.

First: read your refusal letter

The letter sets out why you were refused and which challenge route is open to you — an appeal, an administrative review, or neither. Start there before doing anything else.

Administrative review

An administrative review asks UKVI to correct a caseworking error — it does not allow new evidence, only a re-check of the original decision against what you already submitted.

  • Fee £80 (refunded if the decision is overturned);
  • Deadline: 14 days if you’re in the UK, 28 days if you applied from outside;
  • It can take several months.

Appeal

An appeal to the independent tribunal is generally only available where the decision engages your human rights — most often family life. That’s why appeals are the usual route for refused spouse and parent visas, but not for work or study visas. The tribunal fee is £80 (paper) or £140 (oral hearing).

Visitor visas and “no right of appeal”

Most Standard Visitor visa refusals carry no appeal or administrative review. Your realistic options are to submit a fresh application that directly fixes the refusal reasons, or, in limited cases, judicial review.

Reapplying — do it properly

A knee-jerk reapplication that repeats the same mistakes will usually fail again. Read the refusal carefully, address every concern with better evidence (see our documents checklist approach), and explain anything that was misunderstood.

Judicial review

Where there’s no appeal and an administrative review fails, judicial review in the courts may be the final option — it challenges the lawfulness of the decision, and usually needs legal advice.

Frequently asked questions

What should I do first after a visa refusal?

Read your refusal letter — it explains why you were refused and which route (appeal, administrative review or neither) is open to you.

What is an administrative review?

A request for UKVI to correct a caseworking error using the evidence you already submitted; the fee is £80 (refunded if successful), with a 14-day (in UK) or 28-day (outside) deadline.

When can I appeal a UK visa refusal?

Generally only where the decision engages your human rights, such as family life — common for spouse and parent visas, but not work or study visas.

Can I appeal a visitor visa refusal?

Usually no — visitor refusals carry no appeal or review, so the options are a fresh application addressing the reasons, or judicial review.

Should I just reapply?

Only after addressing every refusal reason with better evidence — repeating the same application is likely to fail again.

What is judicial review?

A court challenge to the lawfulness of a decision, used as a last resort where no appeal exists and an administrative review fails.
